Thailand has introduced a five-year personal income tax exemption on capital gains from the sale of digital assets, including Bitcoin and other cryptocurrencies. The 0% rate applies from January 1, 2025 through December 31, 2029, and was enacted under Ministerial Regulation No. 399 on September 5, 2025, following cabinet approval around June 17, 2025.
The exemption is narrowly defined. It only covers trades executed through platforms licensed by Thailand's Securities and Exchange Commission (SEC). Transactions on unlicensed exchanges, foreign-sourced crypto income, and other non-compliant activity remain subject to standard personal income tax rates, which can reach 35%.
The policy builds on earlier steps to ease crypto taxation. In February 2024, the government waived a 7% value-added tax on crypto gains.
Officials frame the move as an effort to align digital-asset taxation with the treatment of capital gains from traditional securities traded on the Thai stock exchange. Deputy Finance Minister Julapun Amornvivat has promoted the initiative, and government projections suggest tax revenue from the broader digital-asset sector could exceed 1 billion baht (about $30 million) in the medium term.
For investors, the requirement to use SEC-licensed venues may bolster confidence, as licensed exchanges must meet standards for KYC, anti-money laundering controls, and operational security. A key uncertainty is durability: the exemption is set for five years, with no commitment beyond 2029. Because it is implemented via ministerial regulation rather than parliamentary legislation, it could be reversed more easily.
