U.S. crypto regulation is set to advance even if Congress does not pass the CLARITY Act. CFTC Chair Michael Selig said Aug. 4 that the agency's crypto rule proposals are ready and that he intends to finalize them before the current administration ends, with or without new legislation. Separately, SEC Commissioner Hester Peirce has argued the SEC can continue pursuing substantive crypto rulemaking even if Congress fails to act. On Capitol Hill, the Senate left CLARITY untouched before the August recess. Majority Leader John Thune has filed cloture on a motion to proceed, teeing up a procedural vote around Sept. 15. Advancing the bill would require 60 votes. The House passed its own CLARITY version last July by a 294–134 margin. Regulators have already begun building a parallel framework. SEC Chair Paul Atkins unveiled the SEC's "Regulation Crypto Assets" framework in March, while also stressing that only Congress can make the regime "futureproof"; he made the same point again in November 2025. In March, the SEC and CFTC issued a joint interpretation stating most crypto assets are not themselves securities, alongside a token taxonomy addressing staking, mining, wrapping, and airdrops. The CFTC formally joined that interpretation to administer the Commodity Exchange Act consistently with it. The CFTC approved the first U.S. Bitcoin perpetual futures contract in May. Selig has also directed staff to draft rules covering leveraged retail crypto transactions and to create a purpose-built exchange registration category. The SEC has a meeting scheduled for Aug. 14 to consider proposing a dedicated offering regime for certain crypto investment contracts. How durable these moves will be varies widely. The SEC's April staff statement on crypto interfaces labels itself an interim step and says it will be treated as withdrawn after five years unless the Commission acts. The March SEC–CFTC interpretation carries more weight than a staff memo, but the SEC's release notes it may be refined, revised, or expanded as the agency's understanding evolves. Interpretations also face a tougher legal environment after the Supreme Court's Loper Bright ruling ended judicial deference to agency interpretations of ambiguous statutes. By contrast, formal rules—such as an SEC offering regime or a CFTC derivatives framework—are harder to unwind. Any reversal would typically require a new notice-and-comment rulemaking and would be reviewed by courts under the long-standing "arbitrary and capricious" standard. Statutes sit at the top of the durability stack: the CLARITY Act, if enacted, would require Congress to amend or repeal it, and agency leadership could not rewrite it through press releases or staff guidance. The CFTC's reach still has limits without legislation. It already regulates crypto derivatives, enabling fast action on Bitcoin perpetual futures and potential retail-leverage rules. Its authority over spot digital commodity markets is far narrower; the agency has repeatedly said it can police spot markets for fraud and manipulation but lacks broad day-to-day regulatory authority absent new law. Bitcoin, trading in the mid-$60,000s, remains legally clearer than most crypto assets because it already enjoys the strongest commodity treatment and the deepest base of regulated derivatives. A stalled CLARITY vote is less threatening to Bitcoin's basic legal status than it is to token issuers, exchanges, and DeFi platforms still waiting for clear lines. The bigger Bitcoin question is whether delayed legislation slows the buildout of regulated leverage, institutional custody, and bank-facing infrastructure while agencies operate within existing authority. The next four months revolve around two paths. In a bullish scenario, the Sept. 15 cloture vote clears 60 votes, Senate negotiators resolve disputes over ethics, stablecoins, and jurisdiction, and Congress locks in the CFTC's spot-market authority while drawing a clearer boundary between SEC and CFTC oversight. That outcome would bolster institutional confidence and deepen durable market structure for exchanges, custodians, and compliant token projects. In a bearish scenario, the vote fails or advances procedurally only to collapse in negotiations. The SEC and CFTC would continue relying on interpretations, exemptions, and piecemeal rules. Bitcoin would likely remain the least legally fragile major asset, but infrastructure growth could slow, while altcoins, staking services, DeFi, and token issuers keep trading with a legal-risk discount that only Congress can remove. Bottom line: regulators can keep writing the rulebook, but only Congress can make it permanent.
