Hyperliquid's Policy Center said in a post on X that the perpetual futures market has largely migrated offshore as U.S. regulators have not resolved a core classification issue: whether perpetual contracts should be treated as futures or swaps.
The U.S. Commodity Futures Trading Commission (CFTC) began taking steps to address the question in May, allowing the first perpetual contracts to be listed on U.S. exchanges as futures.
Hyperliquid's Policy Center has now submitted applications to the U.S. Securities and Exchange Commission (SEC) and the CFTC seeking confirmation that equity perpetuals can be listed as security futures. The group said regulatory confirmation would provide the clarity needed for these products to return to onshore markets.
Separately, Hyperliquid previously launched the first Anthropic PreIPO market on its platform, which recorded nearly $3 million in 24-hour trading volume.
