The Commodity Futures Trading Commission’s (CFTC) Market Participants Division said it will not recommend enforcement action against "passive" software providers that have not registered as introducing brokers, under specific conditions. The stance extends relief previously granted to Phantom Technologies in March. Under the conditions, the software must not exercise discretion in routing orders, generate buy or sell signals, or custody user assets. All trades must be executed through registered venues. The position remains in place until the Commission issues its own rulemaking.
