Delhi High Court freezes FSSAI action on PepsiCo and Monster ‘Energy Drink’ label until November 5, allows sale of existing stock
AI مارکیٹ کا خلاصہ
The Delhi High Court stayed India's FSSAI restriction on the "Energy Drink" descriptor for PepsiCo and Monster, allowing sale of existing labeled inventory while prohibiting new production using the term pending a Nov. 5 hearing. The ruling temporarily reduces near-term regulatory disruption and enforcement risk for current channel stock, but leaves medium-term labeling and compliance uncertainty unresolved across the caffeinated beverage category.

The Delhi High Court has stayed the Food Safety and Standards Authority of India (FSSAI) directive targeting PepsiCo and Monster Beverage over the “Energy Drink” label, allowing both companies to sell existing inventory carrying the descriptor. The court said the interim relief does not permit manufacturing new products bearing the “Energy Drink” tag. The stay will remain in effect until the next hearing on November 5. It also halted the July 17 communication that had asked state enforcement authorities to implement the order.
